Terms & Conditions of Business

The placing of any orders with A & D Pope Wholesale Nursery (‘Us’ or ‘We’) implies acceptance of the following Terms & Conditions.
The Terms & Conditions are subject to change, so please read them before ordering.

Explanation of Terms
‘Us’ or ‘We’ – A & D Pope Wholesale Nursery
‘Nursery Website – our online store & website located at www.ADPWholesalePlants.com and offers.ADPWholesalePlants.com
‘Online Market’ – our market window as found via www.ADPWholesalePlants.com/opm
‘You’ – the customer or company placing an order with A & D Pope Wholesale Nursery
‘Goods’ – plants, shrubs, trees ordered from Us

Prices quoted are valid for 1 month from quotation date, and are subject to stock availability.

All orders will be invoiced Pro Forma, unless credit has been agreed.
A 30 day Credit Account facility is provided at our discretion to existing, regular customer on request (subject to credit checks and approval).
Cleared payment or payment via Credit Account must be received before orders can be shipped.

Photos of stock on the website and the online market should serve as a guide only, the plants may differ slightly in size, shape or colouring.

VAT is charged on all orders. No discount is given for ‘Cash’ payment.
Products listed on the Online Market are priced before VAT.

Order Processing
Orders from our Nursery Website will be processed in house within a few working days (subject to stock). Cleared payment must be received before Goods can be shipped or collected. Shipping cost is calculated by our Nursery Website and is shown in the checkout.

Orders from our Online Market will be checked by our staff, shipping will be calculated, and a Pro Forma invoice will be emailed to you. Cleared payment must be received before your order can be forwarded to be picked.
The Online Market is a ‘Live’ market place, so stock levels can fluctuate. Therefore all orders are subject to availability. In the unlikely event that a product goes out of stock before your order has been forwarded to be picked, we will endeavour to find a suitable equivalent. If we cannot provide an equivalent for the order price, we will contact you before proceeding.

Every effort will be made to ensure your goods are delivered with a reasonable timescale, however, we cannot accept responsibility for any financial loss incurred due to a late delivery.
Any quoted delivery timescales are subject to prompt payment and stock availability.

If you are collecting your order from Us, collection must be made within 3 working days of the agreed collection date. You will be liable for the cost of the goods ordered regardless of whether collected or not.

Retention of Title
All Goods delivered or collected remain the Property of A & D Pope Wholesale Nursery until full payment has been received.

All orders are checked for quality before shipping.
We will supply all Goods at least up to British Standards and in accordance with the National Plant Specification. Further details of specifications are available from the HTA - www.the-hta.org.uk
The risk in the goods pass to the customer upon Delivery or Collection and it is the customer’s responsibility not to neglect or mistreat the Goods supplied. We hold no liability for any defects resulting from weather, accidents, failure to plant, failure to tend, general neglect or poor soil conditions.
Please refer to our plant care page for advice on tending your new plants.
Any queries, complaints or shortages must be notified to Us in writing within 7 days of receipt of Goods. After 7 days, any relevant issues that become apparent must be reported to Us as soon as possible. Any reasonable queries or complaints will be dealt with fully and sympathetically. If it is necessary that we attend a site inspection, we reserve the right to charge for all expenses incurred in undertaking the visit.
All Orders are bespoke and the Goods are perishable, therefore Returns will only be accepted if there is a problem with the Goods ordered.

Order Cancellation
A request to cancel an order will be accepted at our discretion and only if it received before Goods have been loaded for shipping. After Goods have been loaded, a cancellation would incur significant shipping and restocking costs.
